TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale apply to purchases made from Zech’s Creations LLC through zechscreations.com. By submitting an order, the customer acknowledges that they have reviewed and accepted these terms.

1. Handmade and Custom Products

Many products sold by Zech’s Creations LLC are handmade, made to order, personalized, laser engraved, assembled from natural materials, or produced in small batches.

Natural wood grain, knots, coloration, texture, engraving tone, and other minor variations are normal and make each item unique. Reasonable variations from photographs or samples are not considered defects.

Customers are responsible for reviewing all product descriptions, dimensions, materials, colors, personalization details, spelling, names, dates, and other selections before completing an order.

2. Orders and Payment

Payment is due when the order is placed unless another arrangement has been approved by Zech’s Creations LLC in writing.

An order is not considered accepted until payment has been successfully processed and an order confirmation has been issued.

Zech’s Creations LLC may cancel and fully refund an order because of:

  • Pricing or listing errors
  • Product or material unavailability
  • Suspected fraud
  • An inability to complete the requested personalization
  • A request containing unlawful, infringing, hateful, threatening, or otherwise unacceptable content
  • Other circumstances that make fulfilling the order impractical

3. Personalization and Customer-Supplied Information

Customers are responsible for the accuracy of all names, dates, wording, images, measurements, addresses, design selections, and other information they provide.

When a proof or design preview is provided, production may begin after the customer approves it. Customer-approved spelling, wording, layout, or design choices are not considered production defects.

Zech’s Creations LLC is not responsible for errors contained in information or artwork supplied or approved by the customer.

4. Cancellations

Customers should contact Zech’s Creations LLC as soon as possible if they need to cancel an order.

Before production begins

An order canceled before materials have been committed and production has begun may receive a full refund.

After production begins

Once materials have been committed, personalization has started, or production work has begun, cancellation is not guaranteed.

When Zech’s Creations LLC approves a cancellation after production has begun, the customer may receive a refund of up to 50% of the item price. The remaining amount covers materials, design work, setup time, production time, and other costs already incurred.

Shipping charges will be refunded if the order has not shipped.

Completed or shipped orders

Orders generally cannot be canceled after the item has been completed, personalized, or shipped.

5. Returns and Exchanges

Please purchase confidently and review the product information carefully before ordering.

Because products may be handmade, personalized, made to order, or produced specifically for the customer, all sales are final unless the product is damaged, materially defective, incorrect, or not delivered.

Zech’s Creations LLC does not generally accept returns or exchanges because of:

  • A change of mind
  • Buyer’s remorse
  • Ordering the wrong size, color, pattern, or design
  • Customer-provided spelling or personalization errors
  • Customer-approved design choices
  • Normal variations in natural wood or handmade products
  • Minor differences between screen colors and the physical product
  • Damage caused by misuse, improper storage, modification, neglect, or normal wear

Items must not be returned without prior written authorization. Unauthorized returns may be refused.

6. Damaged, Defective, or Incorrect Items

Customers must inspect their order promptly after delivery.

Damage, a material defect, missing contents, or receipt of the wrong item must be reported through the website contact form within seven calendar days after delivery.

The customer should provide:

  • The order number
  • A description of the problem
  • Clear photographs of the item
  • Photographs of the shipping box and internal packaging
  • A photograph of the shipping label when requested

The customer must retain the product and all original packaging until the issue is resolved because the carrier or insurer may require inspection.

After reviewing the claim, Zech’s Creations LLC may provide an appropriate remedy, including:

  • Repairing the item
  • Replacing the item
  • Reproducing the affected portion of the order
  • Issuing a partial refund
  • Issuing a full refund when repair or replacement is not practical

When Zech’s Creations LLC made the error or an authorized return is required, Zech’s Creations LLC will provide instructions and, where appropriate, cover reasonable return-shipping costs.

7. Shipping and Processing

Processing times vary depending on the product, quantity, customization, availability of materials, and current workload. Any processing estimate shown on a product page, at checkout, or in an order confirmation is an estimate unless expressly identified as a guaranteed date.

Shipping transit times provided by USPS or another carrier are estimates and are outside the direct control of Zech’s Creations LLC.

If Zech’s Creations LLC becomes unable to ship within a promised timeframe, the customer will be contacted and offered the choice of:

  • Accepting the revised shipping timeframe, or
  • Canceling the unshipped portion of the order for a full refund

Customers are responsible for providing a complete and accurate shipping address.

8. Incorrect or Incomplete Addresses

Zech’s Creations LLC is not responsible for delays or nondelivery caused by an incorrect or incomplete address supplied by the customer.

When a package is returned because of an address error:

  • The customer may be responsible for additional shipping charges to resend it.
  • Personalized or made-to-order items are not automatically eligible for a refund.
  • Any refund approved for a non-personalized item may exclude the original shipping cost and costs already incurred.

When Zech’s Creations LLC entered the address incorrectly, Zech’s Creations LLC will correct the problem at no additional cost to the customer.

9. Lost and Undelivered Packages

Zech’s Creations LLC insures its shipped packages when applicable and will assist with carrier searches and insurance claims.

A delayed tracking update does not automatically mean that a package is lost. Zech’s Creations LLC may require a reasonable carrier investigation before treating a shipment as permanently lost.

When a package is confirmed lost or Zech’s Creations LLC determines that it is not reasonably recoverable, the customer will be offered:

  • A replacement at no additional charge, or
  • A full refund of the affected merchandise and the original standard shipping charge

The customer may be required to confirm the shipping address, complete carrier documentation, and cooperate with the insurance claim.

10. Packages Marked Delivered

When tracking shows that a package was delivered to the address provided with the order, the customer should:

  • Check the delivery location and surrounding area
  • Ask other members of the household
  • Check with neighbors when appropriate
  • Contact the local carrier office
  • Contact Zech’s Creations LLC promptly

Packages marked delivered are not automatically considered lost. Zech’s Creations LLC will assist with a reasonable investigation, but refunds or replacements are not guaranteed for theft, disappearance, or loss occurring after confirmed delivery to the correct address.

11. Product Use and Safety

Customers are responsible for using products only for their intended purposes.

Unless expressly described otherwise, decorative products are not toys and may contain small parts, magnets, sharp edges, wood components, adhesives, finishes, or other materials that require responsible handling.

Products should be kept away from children and pets when appropriate. Zech’s Creations LLC is not responsible for damage or injury caused by misuse, unauthorized modification, improper installation, or use contrary to provided instructions.

12. Intellectual Property

Product designs, photographs, descriptions, graphics, logos, artwork, templates, and website content created by Zech’s Creations LLC remain the property of Zech’s Creations LLC unless otherwise stated.

Purchasing a physical product does not transfer ownership of the design or grant permission to reproduce, resell, distribute, or commercially use the associated artwork or files.

Customers represent that they have permission to use any photograph, logo, artwork, wording, or other content they submit for customization. Customers are responsible for claims resulting from unauthorized customer-supplied material.

13. Limitation of Liability

To the fullest extent permitted by applicable law, the liability of Zech’s Creations LLC arising from a product or order will not exceed the amount paid for the affected product.

Zech’s Creations LLC is not responsible for indirect, incidental, special, or consequential losses resulting from shipping delays, carrier disruptions, misuse of a product, or circumstances outside its reasonable control.

Nothing in these terms eliminates rights or remedies that cannot legally be excluded.

14. Governing Law

These Terms and Conditions are governed by the laws of the Commonwealth of Pennsylvania and applicable federal law.

Any consumer protections that cannot legally be waived remain in effect.

15. Contact and Claim Resolution

Customers should contact Zech’s Creations LLC through the contact information provided on zechscreations.com before initiating a payment dispute.

Zech’s Creations LLC will make a reasonable effort to investigate and resolve legitimate order problems directly with the customer.

16. Changes to These Terms

Zech’s Creations LLC may update these Terms and Conditions from time to time. Changes apply to orders placed after the revised terms are published.

The terms in effect when an order is submitted will govern that order.
